Why Retain a Lawyer for IDES, MEB, PEB, and LOD Issues?

When you’re injured and facing the Disability Evaluation System (IDES), a Medical Evaluation Board (MEB), a Physical Evaluation Board (PEB), or a Line of Duty (LOD) determination, the process can feel overwhelming—especially when the outcome affects your career, retirement, and benefits.

Recently, a client who suffered an injury in Korea and received a profile (Army DA Form 3349).  Why hire a private lawyer at all? With his identity protected, we want to share his response to a prompt we often use during intake:

Prompt: “Please create or attach a basic timeline/chronology of events that led to your need for legal representation beginning with your enlistment in the Armed Forces.”

Client response: “People who have been through the process advised me to get a lawyer early and often to ensure that the process isn’t fumbled by trying to do it all myself.”

That sums up the core reason many clients retain us: not because they don’t respect the system—but because the stakes are high and the margin for error is small.

Government counsel is valuable—and we’ll tell you that up front

Here’s what’s different about Citizen Soldier Law: we encourage service members to remember that injured service members are often entitled to government-appointed counsel, and in many cases, that attorney may be experienced and capable.

In other words, you don’t always need to “shell out” for private counsel.

But you may still want a private lawyer for a second opinion, for strategy, or for aggressive advocacy—especially when you believe your case is being misunderstood, delayed, or mishandled.

Why a second set of eyes matters

IDES, MEB, PEB, and LOD issues are paperwork-heavy and deadline-driven. Small missteps—missing records, incomplete narratives, unclear duty impact, unchallenged errors, or late submissions—can have big consequences. A private lawyer can help:

  • Build a clean, persuasive record (medical, line-of-duty, duty performance impact)
  • Identify gaps early before they become irreversible problems
  • Pressure-test the strategy and anticipate how the board will view the evidence
  • Advocate assertively when the system drifts, stalls, or takes a punitive turn

We’ve served—and we’ve been through it

We offer something many firms can’t: firsthand experience navigating the military legal system and the disability evaluation process from the inside. Our team has served, represented thousands of service members, and understands how the process works in real life—not just on paper.

Personally, I was found “fit for duty” after an injury in Germany in 2011. It was daunting even then—and at the time, I was an Army JAG officer who had just completed back-to-back years as a Trial Counsel and then served as a Brigade Judge Advocate. If the system can feel overwhelming to a JAG, it can feel impossible to someone navigating it alone.

You are not alone

You are not alone in this process—and you do not have to blindly accept the first answer you are given. Whether you want a second opinion, a roadmap, or full representation, Citizen Soldier Law is here to help you make informed decisions and protect what you’ve earned.
