National Guard Soldier secures 100% Permanent Disability Retirement

The medical board process can feel overwhelming—especially for National Guard and Reservist Servicemembers who historically receive less assistance with their medical issues. Obtaining knowledgeable legal representation is critical, especially when the outcome impacts your career, finances, or future.

Recently, a National Guard client facing a disability severance determination came to us seeking assistance with obtaining medical retirement benefits. This National Guard client was enrolled in the Army’s Integrated Disability Evaluation System (IDES).

IDES/VA rating was zero “0%”

However, our client’s case was complicated by a proposed VA ratings decision declining to service connect any of his claims, including his unfit condition.

Our thorough review of this client’s case revealed that the initial Line of Duty determination failed to fully capture the extent of his medical symptoms. We assisted our client in obtaining critical medical information from the treating specialist which connected his medical issues to a period of active-duty service. We resolved the case, saved the client thousands of dollars and avoided a formal hearing. Additionally, we used the available VA Compensation and Pension (C&P) exam to request the PEB assign the appropriate Diagnostic Code and rating. This deserving National Guard client was able to receive full medical retirement benefits, which saved our client valuable resources and time.

This client’s result highlights why it is so important to seek representation from attorneys who understand the process. Our attorneys have years of experience working with the Army PEB adjudicators as well as understanding the VA Rating Schedule for Disabilities. We understand that the stakes are high, and the margin for error is small.
